After Richard “Alex” Murdaugh was convicted of murder, he filed a motion for a new trial alleging that the Clerk of Courts tampered with the jury by advising them not to believe his testimony and pressuring them to reach a quick guilty verdict. After an evidentiary hearing where a juror indicated they were influenced by the clerk to return a guilty verdict, the judge overruled the motion finding that there was insufficient evidence to overturn the jury’s verdict. Don’t miss this interactive and entertaining presentation in which Philip Bogdanoff examines the Murdaugh case by showing film clips of testimony regarding jury tampering, discusses case law regarding jury misconduct, and explores the standard of proof to obtain a new trial. A review of the ethical rules regarding interaction with the jury (and the disciplinary cases interpreting these rules) is included.

About the Speaker: Philip Bogdanoff is a nationally recognized continuing legal education speaker. Previously, he served as an assistant prosecutor in Akron, Ohio for nearly thirty years. He worked closely with the police and often made charging decisions on long term investigations. Mr. Bogdanoff also argued cases before the Ohio Ninth District Court of Appeals and the Ohio Supreme Court including cases alleging jury misconduct - before retiring as a senior assistant prosecutor. He still works as a special prosecutor and in 2022 argued three criminal cases before the Ohio Supreme Court. He has done over fifty presentations for prosecutor groups including the Nationa lDistrict Attorneys Association.
